Who owns the machine data? The question Industry 4.0 forgot to ask

Connected factories generate enormous value in machine data, and enormous ambiguity over who is allowed to use it.

There is no natural owner of machine data. Rights arise from contracts, IP and access, and in most industrial deployments those were never clearly allocated.

The tension is structural. The operator generates the data, the equipment vendor wants it for analytics, and the integrator sits in between, each with a plausible claim and no default answer.

The EU Data Act now shapes access to connected-product data, adding statutory rights and constraints to what used to be pure contract.

Confidentiality and IP add another layer, because machine data often reveals process know-how that is itself a protected competitive asset.

The fix is upstream: allocate data rights explicitly in automation, IoT and modernisation contracts, before the data, and the disputes, start flowing.
