MiCA in practice: classifying your token before it classifies you
Under MiCA, the legal nature of a token determines the entire compliance path. Classification is not a formality, it is the strategy.
MiCA created a structured regime for crypto-assets, but it did not simplify the first question: what is your token? Asset-referenced, e-money, utility, or a financial instrument outside MiCA entirely, each answer sends you down a different regulatory road.
The mistake we see most often is designing the token first and asking the legal question second. By then the economics, the marketing and sometimes the code assume a classification the law will not accept.
CASP licensing is a project, not a filing. Custody, exchange, and transfer services each carry their own requirements, and the authorisation timeline shapes your go-to-market.
AML obligations attach regardless. Onboarding, monitoring and the travel rule apply to on-chain flows, and supervisors expect them operational from day one.
Classify early, structure deliberately, and the rest of MiCA becomes navigable. Classify late, and you rebuild.
